EB-5 Immigration Process – Everything You Need to Know
EB-5 immigration program allows foreign investors to apply for and get a Green Card so he and his family can live and work seamlessly in the United States
There are currently several ways to obtain U.S. residency, one of which is the EB-5 Program, which through an investment – with special features – can grant the much-needed Green Card in the U.S.
The U.S. Government is offering this opportunity to foreign individuals who are looking to move into the country and meet the requirements to enter the program.
The complexity of global economic markets and the large number of immigrant workers looking to create a new life have become very popular with the EB-5 program, which every year receives more applications from various countries. But first, what is the EB-5 Program?
What is the EB-5 Immigrant Investor Program
The EB-5 Immigrant Investor Program was created by the U.S. Congress in 1990 as part of the Immigration Act. Its primary objective is to stimulate economic growth and create jobs in the United States.
Over the years, this program has changed the way capital is invested, creating jobs, improving regional infrastructure and stimulating local economies across the Americas and the world.
This program is administered by the U.S. Citizenship and Immigration Service (USCIS). And under this program, investors and their spouses and unmarried children under the age of 21 are eligible to apply for a Green Card by meeting two main requirements.
Making an investment in a commercial company in the United States
Plan to create or retain 10 permanent jobs for qualified U.S. workers
The program’s EB-5 acronyms were chosen because of the fifth preference visa category based on employment.
Process for obtaining the Green Card in the EB-5 Program
The first step in applying for an EB-5 visa is to locate a project with the requirements set out in the program. The investor will then need to hire an immigration attorney to apply for the program by completing Form I-526.
In this step, the interested party must make the investment of $800,000 and transparently disclose the origin of the capital used, for which it must have a source and path of legal funds.
The next step (optional) is, once the first form has been approved, to submit a second document known as Form I-485 that will allow obtaining immigration status to reside in the USA while obtaining the Green Card.
Once this period has elapsed, the investor is already able to adjust his immigration status from “nonimmigrant” to “permanent resident”. Procedure that is recommended to be carried out through an attorney.
The average time to complete the Green Card is 2 years. Although this period may be reduced if it is a project of national interest or located in a rural area.
EB-5 investment financial return
EB-5 investors should know that the capital used will be returned in its entirety, offering increasingly attractive rates of return within the market.
The process begins with the $800,000 capital investment. Then, throughout the entire length of the process, the investor will receive fixed annual dollar returns.
And finally, once the project selected for the program is completed, the investor will be granted an additional profit distribution to what has already been obtained.
