2020 has thrown a curve ball into the investment process. So to help our clients, we decided to share the process for how foreign investors can safely invest and immigrate to the US, without having to get on a plane.
At BAI Capital we offer 3 main types of opportunities to US citizens and foreigners: secure US based Equity, Visa and Property Investments.
All 3 types of BAI investments can be done while abroad – 2020 is not shut for business. In brief, this is how you invest in the US from home:
1. After reviewing our projects, you choose your preferred option.
2. Money is sent and held in a third party government regulated escrow account until the shares or property are purchased, or until the visa petition is filed for the Green Card.
3. Once the process is finished you can enjoy the returns on your investment, and, if you invested for a visa option you may also relocate to America.
But here today, we discuss at length how to start the EB5 Visa Petition and Investment -safely and securely from abroad.
Read on to learn about our first in series of no-hassle and no-headache 2020/COVID-19 US Investment Strategies with BAI Capital. Be sure to check back for our next investment support emails, about how to safely invest in Equity, Property and the E2 Treaty Investor Visa, all WITHOUT having to leave your country.
The EB5 Visa | The Working Partnership between Immigrant Investors, the US Government & 3rd Party Private Project Managers
The EB5 Immigration Program was created in 1990 by the Immigration Act of 1990 and provides a way for eligible investors to become lawful permanent residents – known as the Green Card – by investing at least 900,000 USD plus expenses into an enterprise that will create new jobs through a new business or project.
The enterprise that manages the invested funds is not the government nor government related, but should have a business relationship with a Federal approved third entity known as Regional Center, who has the responsibility of accounting and reporting on a yearly basis how the funds have been invested.
In other words, while EB5 is a Government and Federal program regulated by the US Congress, it is administrated and executed by private third parties such as our company. BAI Capital creates new jobs with the funds of investors and in return investors will obtain the Green Card and potential financial profits.
Let’s be clear. There are many companies and projects like us in the United States.
However, there aren’t that many with a 100% success rate in petition approval.
BAI is the winner of the EB5 Migration Agency Industry awards in 2017 and 2018, and nominated once again in 2019.
Our company is known for its transparency and accountability in US foreign investments. In the case of the EB5 Visa Program, we are only one part of the Team that helps the investor obtain their US Green Card.
The working EB5 partnership consists of several key players and partners.
1. The Investor Immigrant
2. The NCE -New Company Enterprise
3. The Regional Center
5. Immigration attorney
6. The JCE -Job Creating Entity
7. Escrow Agent
All together, this “Team” creates infrastructure and US jobs, and in the process grants the investor the opportunity to gain the US Green Card for themselves and their family, all while earning a return on their investment.

EB5 Steps for the Immigrant Investor: Applying from abroad.
In order to begin with the petition you as the investor need to follow the following steps:
The investor will hire directly and independently an immigration attorney in order to build the evidence that the capital invested was obtain through lawful means.
The cost of this legal representation is in the range of 15,000 USD to 25,000 USD.
We recommend Greenberg Traurig Law Firm recognized as leaders in US Immigration.
Once the source of funds is documented the investor will need to wire the investment capital of 900,000 USD plus expenses 50,000 USD to an “escrow account”.
An escrow account is managed by a third independent party registered with the SEC who sole responsibility is to held the funds in their own account until the Petition is sent to United States Citizen and Immigration Services -USCIS.
We work with Granite Escrow recognized as leaders in EB5 Escrow.
Once the documents are ready and the capital is in the escrow account of the project the attorney will send the petition for the Green Card to USCIS (known as I-526).
In 2 weeks USCIS will issue a formal notice an assign a case number to the investor. The investor will be able to track the case status on the website of USCIS.
The funds will be released from the escrow account to the project account only after USCIS assign a case number. The response to the petition may take anywhere from 18 months to 36 months.
Once the I-526 petition is approved investor will proceed to change his current VISA status to Permanent Green Card. Once inside USA can issue social security ID. In 5 years may request the Citizenship.
In order to receive the Green Card, a visit to the USA will be required at some point in the process.
The best way to invest from abroad, whether it be EB5 Visa, Equity or Property, is to do your due diligence and choose a reputable middle man company.
In the case of EB5 Visa Investments, unfortunately there are bad players in the USA who have taken advantage of foreign investors. It ends up badly for everyone, the investors lose their money and the NCE goes to jail. In response to this type of criminal activity, we encourage all of our prospects and clients to research us on the internet, and contact our partners as well as the USCIS.
At BAI Capital we operate with full transparency and accountability and can proudly claim that over the last 8 years 100% of our EB5 petitions have been approved.
We welcome your questions.
And we look forward to helping each and every one of you with all of your investment and immigration goals whether it be EB5 or E2 Visas, US Equity Investments or US Property Ownership.
