The EB-5 Immigrant Investor Program was created in 1990 by the Immigration Act of 1990 and provides a way for eligible investors to become lawful permanent residents – known as the Green Card – by investing at least 900,000 USD plus expenses into an enterprise that will create new jobs through a new business or project.

The enterprise that manages the invested funds is not the government nor government related, but should have a business relationship with a Federal approved third entity known as Regional Center, who has the responsibility of accounting and reporting on a yearly basis how the funds have been invested.

In other words, while EB-5 is a Government and Federal program regulated by the US Congress, it is administrated and executed by private third parties such as our company. BAI Capital creates new jobs with the funds of investors and in return investors will obtain the Green Card and potential financial profits.

EB5 Steps for the Immigrant Investor: Applying from abroad.

In order to begin with the petition you as the investor need to follow the following steps:

Step 1
The investor will hire directly and independently an immigration attorney in order to build the evidence that the capital invested was obtain through lawful means.
The cost of this legal representation is in the range of 15,000 USD to 25,000 USD.

We recommend Greenberg Traurig Law Firm recognized as leaders in US Immigration.

Step 2
Once the source of funds is documented the investor will need to wire the investment capital of 900,000 USD plus expenses 50,000 USD to an “escrow account”.
An escrow account is managed by a third independent party registered with the SEC who sole responsibility is to held the funds in their own account until the Petition is sent to United States Citizen and Immigration Services -USCIS.

Step 3
Once the documents are ready and the capital is in the escrow account of the project the attorney will send the petition for the Green Card to USCIS (known as I-526).
In 2 weeks USCIS will issue a formal notice an assign a case number to the investor. The investor will be able to track the case status on the website of USCIS.
The funds will be released from the escrow account to the project account only after USCIS assign a case number. The response to the petition may take anywhere from 18 months to 36 months.

Step 4
Once the I-526 petition is approved investor will proceed to change his current VISA status to Permanent Green Card. Once inside USA can issue social security ID. In 5 years may request the Citizenship.

In order to receive the Green Card, a visit to the USA will be required at some point in the process.


The best way to invest from abroad, whether it be EB5 Visa, Equity or Property, is to do your due diligence and choose a reputable middle man company.

In the case of EB5 Visa Investments, unfortunately there are bad players in the USA who have taken advantage of foreign investors. It ends up badly for everyone, the investors lose their money and the NCE goes to jail.
