EB-5 Legal Glossary to obtain a Green Card

The EB-5 Immigrant Investor Program, also known as an investor visa, allows individuals to apply for a Green Card to live with their family in the United States. It is a long process that includes several phases and terms. So we’ve created a glossary so you know exactly what each component means.

In order for an investment to qualify for the EB-5 program, it must meet certain requirements. Like generating at least 10 full-time jobs and engaging modern businesses.

The process consists of 4 steps in which the data subject must complete various documents. These include Form I-526, which demonstrates that the appropriate investment has already been made, and Form DS-260, which will allow immigrant visa application. Among other objectives.

It is important to consider that the minimum amount to invest under U.S. law is US800,000. And the normal attainment period is approximately 2 years, which can be decreased if the project is located in a rural or low employability area (Target Employment Area).

  • Accreditation Questionnaire: future EB-5 investors are generally required to complete accreditation questionnaires stating that they are accredited investors and therefore qualify for certain exceptions to U.S. legislative securities while participating in the EB-5 program.
  • Conditional Permanent Residence: Conditional permanent residents are those who have been granted a green card but have certain restrictions on their residence.
  • U.S. Permanent Residence: A permanent resident, is an immigrant who has received a green card that allows him to live and work in the United States permanently.
  • Nonimmigrant Visa: allow immigrants to live and work in the United States for a certain period of time.
  • Family Permanent Resident Visa: Family Permanent Resident Visas are reserved for family members of permanent residents.
  • Temporary Work Visa: Temporary Work Visas are granted to workers who will enter the United States for temporary work.
  • Visitor Visa: Visitor Visas allow foreigners to visit the United States for a certain amount of time.
  • H1B Visa: H1B Visas allow foreign workers to immigrate to the United States to work in a U.S. business.
  • J-1 Visa: J-1 Visas allow participants in a study or work exchange program to enter the United States for a certain period of time.
  • Immigrant Visas: Visa categories that allow foreign nationals to become permanent residents of the United States.
  • Family Preference Visas: Family Preference Visas are immigrant visas reserved for immediate family members of U.S. citizens.
  • Immigrant Work Visas: Immigrant Work Visas provide foreign workers with the basis for obtaining permanent U.S. residency.
  • Work Visas: Work Visas allow foreign workers to obtain their permanent residence in the United States.
